Quite often we are retained by companies who have very limited information regarding an incident which occurred at their place of business.

OHIO INTEL recommends that every employer should develop a policy and investigative protocol for accidents that occur in the workplace. We recommend that the employer should conduct an investigation even if no injuries are initially claimed by any employee. Your policy should be approved by your legal counsel and your insurance company. We recommend that your investigative protocol should at the very least include:

• Obtaining written statements from all persons involved in and witnesses to the incident.
• Obtain a written statement form any employee who is claiming an injury.
• Photograph the scene of the incident and any equipment which was involved.
• Photograph all visible injuries received by the employee.
• Notify legal counsel and your insurance company of the incident as soon as possible.
